Authorization for Home Inspection Services



COMPANY (Refers in this agreement to AmericanHome Inspection Professionals, LLC) agrees to conduct an inspection for the purpose of informing the CLIENT primarily of the major deficiencies in the condition of the property in accordance with the American Society of Home Inspectors (ASHI) Standards (the inspection will meet or exceed these standards). The inspection, written report and any other form of media are performed and prepared for the sole, confidential and exclusive use and possession of the CLIENT; the report is nontransferable. The report, and any other associated media, may not be published except by the written authorization of the Company.

The inspector is a generalist trained to evaluate the home. The written report will include the following only:

* general exterior, including roof, siding, windows, chimney, drainage, grading and general vegetation
* structural condition of the visible foundation & framing
* electrical, plumbing, water heater, heating and air conditioning
* general interior, including visible portions of the ceilings, walls, floors, windows, insulation and ventilation

Maintenance and other items may be discussed but they are generally not a part of the inspection. The report is not a compliance inspection or certification for past or present governmental codes or regulations of any kind and is only based on the inspector’s opinions. The inspector WILL NOT turn on utilities as a matter of course (electrical and or water may be the exception at the discretion of the inspector only).

It is understood and agreed that the inspection will be of readily accessible areas of the building and is limited to visual observations of apparent conditions existing at the time of the inspection only. The inspection is NOT technically exhaustive. Latent and concealed defects and deficiencies are excluded from the inspection; equipment, items and systems will not be moved or dismantled (panels designed to be removed for inspection excepted). Detached structures (not considered part of the main home) are normally not included. The COMPANY will be under no obligation under any circumstances for any further follow-up inspection. (re-inspections of corrected issues at an additional cost)

ENVIRONMENTAL HAZARDS including but not limited to: asbestos, lead paint/pipes/solder, mold, radon (Radon tests are available at an additional cost), urea formaldehyde, toxic wastes, illegal drug residue, polluted water, contaminants and all pollutants and hazardous material are not part of this inspection. If the inspector suspects any of these, an evaluation by a professional in that area is recommended. Auxiliary systems such as Clothes Washers and Dryers (unless staying with home and inspector is advised) Alarm, Solar, Private Water, Private Sewer, Security, Sprinkler, Elevator, Intercom, Central Vacuum, Swimming Pools, Space Heaters, Room Air Conditioners, Personal Appliances, Outdoor Jacuzzis, Spas, Saunas, or any system not considered a part of the major building systems are not a part of the inspection process. In addition, no inspection for household rodents or insects will be done. Visible evidence of Rodents/Wood destroying insects may be mentioned and or discussed in this report and recommendations given as a courtesy only.

The parties agree that the COMPANY, and its employees and agents, assume no liability or responsibility for the cost of repairing or replacing any unreported defects or deficiencies, either current or arising in the future, or for any property damage, consequential damage or bodily injury of any nature. THE INSPECTION AND REPORT ARE NOT INTENDED OR TO BE USED GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, REGARDING THE ADEQUACY, PERFORMANCE OR OF ANY INSPECTED STRUCTURE, ITEM OR SYSTEM. COMPANY IS NOT AN INSURER OF ANY INSPECTED CONDITIONS OR ITEMS.

It is understood and agreed that should COMPANY and/or its agents or employees be found liable for any loss or damages resulting from a failure to perform any of its obligations, including but not limited to negligence, breach of contract or otherwise, then the liability of COMPANY and/or its agents or employees, shall be limited to a sum equal to the amount of the fee paid by the CLIENT for the Inspection and Report. Client agrees to pay our reasonable attorney fees and litigation costs associated with the collection of any unpaid fees associated with this inspection. Client agrees to a 1 (one) year statute of limitation for filing a complaint against the inspector for findings related to the home or report. Inspector reserves the rights to alter and or amend the report. Client agrees to provide the Company with third party indemnification and wavier of subrogation. Client agrees to contact inspector before any repairs are made to home if repairs are considered to be due to inspector’s failure to notify client of issue (emergency issues excepted). The parties agree that a faxed or emailed copy of this agreement can be relied upon in lieu of the original.
